Terms & Conditions
1. Scope
These Terms & Conditions (“Terms”) apply to all contracts concluded through the online store www.serique.de between:
Jan Kramer
56368 Katzenelnbogen
Germany
hereinafter referred to as the “Seller”, “we”, “us” or “our”,
and consumers, hereinafter referred to as the “Customer”, “you” or “your”.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession within the meaning of Section 13 of the German Civil Code (BGB).
The version of these Terms valid at the time the order is placed shall apply. Any deviating terms and conditions of the Customer shall not apply unless expressly agreed to by us.
2. Conclusion of the Contract
The presentation of products in our online store does not constitute a legally binding offer but an invitation to place an order.
You may add products to your shopping cart and review or correct your information before submitting your order.
By clicking the final order button that clearly indicates that the order involves an obligation to pay, you submit a binding offer to purchase the products contained in your shopping cart.
After placing your order, you will receive an automated email confirming receipt of your order. Unless expressly stated otherwise, this email does not constitute acceptance of your offer.
The purchase contract is concluded when we expressly accept your order, send you a shipping confirmation, or dispatch the ordered goods.
We store the relevant order information in accordance with applicable legal requirements. Your order information and these Terms will be made available to you electronically.
3. Prices and Shipping Costs
All prices shown in our online store are final prices.
As a small business within the meaning of Section 19 of the German VAT Act (UStG), VAT is not separately stated.
Shipping is free, unless otherwise expressly stated during checkout.
Any additional costs that may apply will be clearly displayed before you submit your order.
4. Payment
The payment methods currently available to you will be displayed during checkout and may include, depending on your country and availability:
Visa
Mastercard
American Express
PayPal
Apple Pay
Google Pay
Shop Pay
Klarna
UnionPay
Where payment is processed by a third-party payment provider, the respective provider's additional terms and conditions may apply.
Unless otherwise stated for the selected payment method, payment is due immediately upon conclusion of the contract.
We reserve the right to offer or restrict individual payment methods depending on availability, country, order value or the requirements of the respective payment provider.
5. Delivery and Delivery Times
We deliver to the countries that are available for selection during checkout.
Delivery will be made to the delivery address provided by the Customer during checkout.
Unless otherwise stated on the respective product page, the estimated delivery time is 4–9 business days after receipt of payment.
Delivery times are estimates and may vary depending on the destination, carrier and circumstances outside our reasonable control.
If an ordered product becomes unavailable, we will inform you as soon as possible.
If delivery cannot be completed within a reasonable period and the contract is cancelled or you are otherwise entitled to withdraw from the contract, any payments already received for the affected goods will be refunded in accordance with applicable law.
6. Retention of Title
The goods remain our property until the purchase price has been paid in full.
7. Right of Withdrawal and Voluntary Returns
Statutory Right of Withdrawal
Consumers generally have a statutory 14-day right of withdrawal for distance contracts.
Further information regarding your statutory right of withdrawal, including the applicable conditions, deadlines and procedure, can be found in our separate Cancellation Policy.
The statutory right of withdrawal remains unaffected by any additional voluntary return policy offered by us.
Voluntary 30-Day Return Policy
In addition to your statutory rights, we voluntarily offer a return period of 30 days from the date you receive your order.
Items returned under this voluntary return policy must:
be unworn and unused;
be in their original condition;
show no signs of wear, washing, damage or alteration; and
where reasonably possible, be returned with their original packaging and tags.
Returns under this voluntary return policy are at the customer’s own expense. The customer is responsible for all return shipping costs.
After we receive and inspect the returned goods, the purchase price will be refunded using the applicable refund method.
This voluntary return policy does not limit or affect your statutory right of withdrawal or your statutory rights regarding defective goods.
8. Statutory Warranty Rights
The statutory warranty rights for defects apply.
Normal wear and tear caused by ordinary use does not constitute a defect for which we are responsible.
This also applies to damage caused after delivery by improper use, incorrect storage, failure to follow care instructions, improper washing or other handling for which we are not responsible.
Product colors may appear slightly different depending on your screen settings, lighting conditions or device.
Your statutory rights remain unaffected where the delivered product does not conform to the contract.
9. Liability
We are liable without limitation for damage caused intentionally or through gross negligence and for damage resulting from injury to life, body or health.
In the event of a slightly negligent breach of an essential contractual obligation, our liability shall be limited to the typical and foreseeable damage.
Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment the Customer may regularly rely.
Otherwise, liability for slight negligence is excluded to the extent permitted by law.
Liability under the German Product Liability Act (Produkthaftungsgesetz) and other mandatory statutory liability provisions remains unaffected.
10. Consumer Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
11. Governing Law
The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer and have your habitual residence in another country, this choice of law shall not deprive you of the protection provided by mandatory provisions of the law of the country in which you have your habitual residence.
12. Final Provisions
If any provision of these Terms is or becomes invalid or unenforceable, this shall not affect the validity of the remaining provisions, subject to applicable mandatory law.
